Personal Video Uploads

As part of our Services, you may have the option to upload a personal video that will be linked to your order and accessed through a QR code inside your gift box. By uploading a video, you acknowledge and agree to the following:

  • Data Storage and Retention: Uploaded videos are stored securely by our service providers and will be retained for a maximum of six (6) months from the date of upload. After this period, videos will be permanently deleted from our systems.

  • Customer Responsibility for Content: You are solely responsible for the content of any video you upload. Videos must not contain unlawful, harmful, offensive, discriminatory, defamatory, or otherwise inappropriate material.

  • Right to Refuse or Remove: We reserve the right, at our discretion, to refuse to process, remove, or disable access to any video that we believe violates this policy, applicable law, or our Terms of Service.

  • Limitation of Liability: Wikid Gifts accepts no liability for any loss, harm, distress, or damage caused by videos uploaded by customers, including but not limited to videos that may cause offense to recipients or third parties. By using this feature, you agree that you upload content at your own risk and that we are not responsible for the consequences of the content you choose to provide.

Welcome to Wikid Gifts! The terms “we”, “us” and “our” refer to Wikid Gifts. Wikid Gifts operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated chocolate gifting experience (the “Services”). Wikid Gifts is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”) describe your rights and responsibilities when you use the Services.

SECTION 2 - OUR PRODUCTS

We make every effort to provide an accurate representation of our chocolate hampers and related products. However:

  • Colours, packaging, and product appearance may differ slightly from what appears on your device.

  • Chocolate and other food products are perishable and may be sensitive to storage conditions, temperature, and handling.

  • All product descriptions and availability are subject to change without notice.

  • We may discontinue or limit certain hampers at our sole discretion.

  • We do not warrant that the quality of any products, services, or packaging will meet your expectations.

SECTION 3 - ORDERS

When you place an order, you are making an offer to purchase. Wikid Gifts reserves the right to accept or decline your order at our discretion. Your order is not accepted until confirmed by us and payment has been processed.

Please review your order carefully before submitting. Due to the perishable nature of our hampers, cancellations may not be possible once an order has been prepared or shipped.

All purchases are subject to our Refund & Return Policy [LINK], which governs returns and refunds.

You represent and warrant that your purchases are for personal use only and not for commercial resale or export.

SECTION 4 - PRICES AND BILLING

Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs or import charges.

Prices posted in our online store may be different from prices offered elsewhere. We may offer promotions that may affect pricing and that are governed by separate terms. If there is a conflict between the promotion terms and these Terms, the promotion terms will govern.

You agree to provide current, complete and accurate purchase, payment and account information for all purchases. You agree to promptly update your account and other information, including your email address, credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

You represent and warrant that:
(i) the credit card information you provide is true, correct, and complete,
(ii) you are duly authorized to use such credit card for the purchase,
(iii) charges incurred by you will be honored by your credit card company, and
(iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes.

SECTION 5 - SHIPPING AND DELIVERY

  • We aim to deliver hampers within estimated timeframes, but delivery times are not guaranteed.

  • Once products are handed to the courier, title and risk of loss pass to you.

  • We are not responsible for delays caused by couriers, weather, customs, or incorrect/incomplete delivery details provided by you.

  • In the event of delivery failure due to an incorrect address, we are not obligated to provide a replacement or refund.

SECTION 6 - INTELLECTUAL PROPERTY

All content on our Services, including but not limited to trademarks, logos, brands, text, displays, images, graphics, product reviews, videos, and audio, as well as the design, selection, and arrangement thereof, are owned by Wikid Gifts, its affiliates or licensors and are protected by copyright, trademark, and intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent.

Unauthorized use of the Services may be a violation of intellectual property laws. All rights not expressly granted herein are reserved by Wikid Gifts.

Wikid Gifts is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Wikid Gifts. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Wikid Gifts, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Wikid Gifts.

SECTION 17 - ALLERGENS & DIETARY REQUIREMENTS

  • Transparency: All hampers and products include ingredient and allergen information on our website and/or packaging. Common allergens may include, but are not limited to: milk, soy, nuts, peanuts, gluten, wheat, and eggs.

  • Cross-Contamination: Our hampers are packed in environments where multiple allergens are present. We cannot guarantee any item is completely free from traces of allergens.

  • Customer Responsibility: It is the responsibility of the customer and/or gift recipient to review all allergen information before consumption. If unsure, we strongly advise against consuming the product.

  • No Liability: Wikid Gifts accepts no liability for allergic reactions, intolerances, or adverse health consequences arising from consumption of our products. By purchasing or consuming our hampers, you acknowledge and accept this risk.

  • Medical Advice Disclaimer: Our ingredient and allergen information is provided for general informational purposes only and does not constitute medical advice. Customers with allergies or dietary concerns must consult a qualified healthcare professional before consumption.

SECTION 18 - INDEMNIFICATION
